ASSUMPTION OF RISK AND WAIVER OF LIABILITY

 

In consideration of Matin Vu and Sara Vu (collectively, “Coach Martin”) permitting the child named as Player on the registration form (the “Child”) to participate in the basketball club training program and any activities related to basketball club team bonding which may occur within or outside of the training period (the “Activities”), and for other good and valuable consideration, I, parent or legal guardian of the Child (“I”, “me”, or the “Parent”), agree to all the terms and conditions set forth in this agreement (this “Agreement”).

 

Assumption of Risks

I, the Parent, am aware and understand that I am allowing my Child to participate in the Activities which involve many risks, dangers, and hazards, including but not limited to the risk of serious injury, death, or property damage.  I, the Parent, understand and acknowledge that the basketball training program entails rigorous basketball training, drills, scrimmages, games, exercises, and the possibility of risky non-basketball related activities such as swimming or pool or hot tub play for team bonding to name only a few, and that I am voluntarily allowing my Child to partake in all Activities despite many risks associated with such.  I freely accept and fully assume any and all of the risks, dangers, and hazards involved and the possibility of injury, death, or property damage related to my Child’s participation in the Activities. 

 

Waiver of Liability

I, for my Child and myself and on behalf of my heirs, assigns, personal representatives, and next-of-kin, hereby expressly waive and release any and all claims which I have or may in the future have against Coach Martin, Ace Hoops, On Ouch, any property used during the administration of the Activities, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors, and assigns (collectively, the “Releasees”) arising out of or attributable to my Child’s participation in the Activities, due to any cause whatsoever.  I agree not to make or bring any such claim against Coach Martin, Ace Hoops, On Ouch or any other Releasee, and forever release and discharge Coach Martin, Ace Hoops, On Ouch and all other Releasees from liability under such claims.

 

I attest that my Child is physically, mentally, and emotionally able and healthy to participate in all of the Activities and will not hold Coach Martin or any other Releasee responsible in any manner whatsoever should my Child not be able to perform any part of or all of the Activities.  I understand and agree that Coach Martin and any property where any Activities are performed, and any helpers, trainers, or coaches used in the administration of the Activities (collectively, the “Parties”) will not be held responsible in whole or in part for any accidents, illness, or injuries resulting in medical, dental, or any other expenses incurred as a result of my Child’s participation in the Activities.  I hereby release and discharge the Parties from and against any and all claims, costs, liabilities, and injuries resulting from such.  In the event of any emergency, I authorize Coach Martin or the Parties to exercise its judgment in the treatment of my Child and will accept entirely the outcome of their decisions made.

 

Severability

If any term or provision of this Agreement is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
